Narrative:
En route from toronto to new york, lga. During cruise flight at FL240 our TCASII system detected a target at 12 O'clock and closing rapidly and climbing to FL230. ATC had not issued a TA. As the intruder closed on us, our TCASII system commanded a climb and the crew responded with an immediate climb to FL247, then acquired the traffic visually. Returned to FL240 and notified ATC of the deviation from assigned altitude.

Title: FLC OF AN LGT ACR ACFT CLBED ABOVE ASSIGNED CRUISE ALT IN RESPONSE TO A TCASII RA.
Narrative: ENRTE FROM TORONTO TO NEW YORK, LGA. DURING CRUISE FLT AT FL240 OUR TCASII SYS DETECTED A TARGET AT 12 O'CLOCK AND CLOSING RAPIDLY AND CLBING TO FL230. ATC HAD NOT ISSUED A TA. AS THE INTRUDER CLOSED ON US, OUR TCASII SYS COMMANDED A CLB AND THE CREW RESPONDED WITH AN IMMEDIATE CLB TO FL247, THEN ACQUIRED THE TFC VISUALLY. RETURNED TO FL240 AND NOTIFIED ATC OF THE DEV FROM ASSIGNED ALT.
