Narrative:

I was working departure radar east at mco ATCT. I had just assumed control of the position after a position relief briefing. During the briefing a radar handoff was accepted from patrick AFB RAPCON on military X, a T-34, IFR at 5000 wbound, requesting 8000. Upon assuming the radar position I took a radar handoff on air carrier Y, MD88, IFR from mlb to atl, climbing to 5000 (per LOA), requesting FL310. When I took the handoff on Y, the aircraft were 5 to 6 NM apart and on approximately parallel tracks. The LOA calls for jets off mlb northbound over orl to be at 5000 direct to orl. In this situation with the T-34 north of Y level at 5000 I expected Y to stay on a parallel heading. I could not climb the T-34 because he was under another sector's airspace. The track on air carrier Y turned toward military X. The tracks were now converging, both aircraft level at 5000. The controller who was relieved attempted to coordinate with patrick AFB to take action to correct the situation. At that time, air carrier Y made initial contact on my frequency. I immediately issued clearance to climb to 8000 to Y. I estimate the aircraft were 400 ft and 2 mi at the closest point. The loss of standard separation occurred in patrick AFB airspace. It is my opinion this situation occurred because of the actions of the patrick AFB controller. Myself and the controller I relieved took every possible action to correct the situation.

WHEN I TOOK THE HDOF ON Y, THE ACFT WERE 5 TO 6 NM APART AND ON APPROX PARALLEL TRACKS. THE LOA CALLS FOR JETS OFF MLB NBOUND OVER ORL TO BE AT 5000 DIRECT TO ORL. THE TRACKS WERE NOW CONVERGING, BOTH ACFT LEVEL AT 5000. THE CTLR WHO WAS RELIEVED ATTEMPTED TO COORDINATE WITH PATRICK AFB TO TAKE ACTION TO CORRECT THE SIT. AT THAT TIME, ACR Y MADE INITIAL CONTACT ON MY FREQ. I IMMEDIATELY ISSUED CLRNC TO CLB TO 8000 TO Y. I ESTIMATE THE ACFT WERE 400 FT AND 2 MI AT THE CLOSEST POINT. THE LOSS OF STANDARD SEPARATION OCCURRED IN PATRICK AFB AIRSPACE. IT IS MY OPINION THIS SIT OCCURRED BECAUSE OF THE ACTIONS OF THE PATRICK AFB CTLR.
