Narrative:
A spurious TCASII RA caused air carrier X to climb from FL390 while cpr Y (LR24) was passing overhead at FL410. The pilot of X said he was climbing to avoid traffic 200 ft below him. To the best of my knowledge there was no traffic below X. A TCASII RA caused this problem and only the removal of TCASII from the ATC system until it works properly will correct it.

Title: ACR X FALSE TCASII RA UNAUTH CLB HAD LTSS FROM CPR Y.
Narrative: A SPURIOUS TCASII RA CAUSED ACR X TO CLB FROM FL390 WHILE CPR Y (LR24) WAS PASSING OVERHEAD AT FL410. THE PLT OF X SAID HE WAS CLBING TO AVOID TFC 200 FT BELOW HIM. TO THE BEST OF MY KNOWLEDGE THERE WAS NO TFC BELOW X. A TCASII RA CAUSED THIS PROB AND ONLY THE REMOVAL OF TCASII FROM THE ATC SYS UNTIL IT WORKS PROPERLY WILL CORRECT IT.
