Narrative:
Student was receiving his final phase check prior to his private pilot check ride. I asked him to divert to the lvk airport. He had not done superbly on his maneuvers and I wanted to check his airport work. After landing (which wasn't that great) we taxied back after the tower said something like, 'taxi back to the runway at your option.' it was not a completely standard transmission. On the way back to the runway I tried to reassure the student that the foundations were there to be a good pilot, he just needed more practice. Backgnd radio xmissions were taking place also upon reaching the hold short line the student did not stop. I said, 'have you got a clearance?' he said 'yes.' I said 'stop!' by this time the aircraft was 1/2 way over the line. I told the student to confirm he had a clearance. The tower then asked if we were on the runway. The student said, 'yes.' the tower proceeded to make clear our error. (I believe my student thought the tower cleared him for takeoff when he heard the word option.) I was in check ride mode and erroneously stopped being in instructor mode. I was allowing him to make errors without jumping in to stop him from making errors, so that I could ascertain his readiness for the check ride. Mr. X of the san jose FSDO told me on my part 141 check ride that we should do this. But, I was not quick enough to stop my student from proceeding. I should have immediately applied the brakes without question. Needless to say the student did not pass his check ride and I will be quicker in future. I will also reemphasize the need for students to read the pilot/controller glossary in the aim. Question the tower if in any doubt about a clearance. Always stop momentarily at the hold bars to do final items which should include the question 'do I have clearance.' this was the second phase check I have given and the first of its type. I think subconsciously I was expecting more from the student at his level, and so was lulled into not being right there on the controls as one would with a beginner. I feel awful. This will not happen again with me on board.

Title: SPI TAXIES ACROSS HOLD LINE WITHOUT CLRNC FOR TKOF.

I THINK SUBCONSCIOUSLY I WAS EXPECTING MORE FROM THE STUDENT AT HIS LEVEL, AND SO WAS LULLED INTO NOT BEING RIGHT THERE ON THE CTLS AS ONE WOULD WITH A BEGINNER. I FEEL AWFUL. THIS WILL NOT HAPPEN AGAIN WITH ME ON BOARD.
