Narrative:
At FL310 we were watching TCASII as target at same altitude displayed on screen converging. First officer asked mkjk center about traffic. She stated we were also at FL310. She asked if we were FL310 or FL350. We stated we had asked for FL350 but were denied by previous controllers, including her kingston center. As I took evasive action, a turn to the northwest, the 737 descended. We both acknowledged each other's presence. As I again requested FL350 kin center again denied. My TCASII showed about 2 mi from the 737. He thought about 1 1/2 mi at closest point.

Narrative: AT FL310 WE WERE WATCHING TCASII AS TARGET AT SAME ALT DISPLAYED ON SCREEN CONVERGING. FO ASKED MKJK CTR ABOUT TFC. SHE STATED WE WERE ALSO AT FL310. SHE ASKED IF WE WERE FL310 OR FL350. AS I AGAIN REQUESTED FL350 KIN CTR AGAIN DENIED. MY TCASII SHOWED ABOUT 2 MI FROM THE 737. HE THOUGHT ABOUT 1 1/2 MI AT CLOSEST POINT.
