Narrative:
While level at 8000 MSL on vectors to final approach to newark runway 22L, TCASII gave resolution of 1500 FPM climb to avoid aircraft climbing to our altitude. We took evasive action, climbed to 8900 ft with traffic in sight. Upon advising ATC, they thought we were at 6000 MSL. Whether or not clearance to 6000 ft was given and not received or just not given we do not know. Our last assigned and acknowledged clearance was 020 heading 8000 ft MSL. It appeared the other aircraft leveled off while we climbed.

Narrative: WHILE LEVEL AT 8000 MSL ON VECTORS TO FINAL APCH TO NEWARK RWY 22L, TCASII GAVE RESOLUTION OF 1500 FPM CLB TO AVOID ACFT CLBING TO OUR ALT. WE TOOK EVASIVE ACTION, CLBED TO 8900 FT WITH TFC IN SIGHT. UPON ADVISING ATC, THEY THOUGHT WE WERE AT 6000 MSL. WHETHER OR NOT CLRNC TO 6000 FT WAS GIVEN AND NOT RECEIVED OR JUST NOT GIVEN WE DO NOT KNOW. OUR LAST ASSIGNED AND ACKNOWLEDGED CLRNC WAS 020 HDG 8000 FT MSL. IT APPEARED THE OTHER ACFT LEVELED OFF WHILE WE CLBED.
