Narrative:
At 9500 ft VFR with radar advisories from ZNY on transponder code XXXX, 5 NM east of seg VOR (ny), no clouds above or below me. ATC issued a TA: traffic 10 O'clock, 4 mi at 9.4 mi, southeast heading (my heading was 060 degrees). I picked up the target visually at approximately 1 1/2 to 2 mi -- at my altitude. I quickly became aware we were converging and determined since the intruder was maintaining heading and altitude, that I would descend immediately. At 9250 ft the white top/burgundy bottom colored mooney passed directly overhead my aircraft. If I had not descended, we would have hit. The other aircraft did not appear to see me since I never saw him take any evasive action. Because of the type of callout ATC made on this target, he was not in radio contact with the ZNY. I thanked the controller for the traffic call, advising him that if he had not pointed it out I would have hit him (the intruder aircraft).

Narrative: AT 9500 FT VFR WITH RADAR ADVISORIES FROM ZNY ON XPONDER CODE XXXX, 5 NM E OF SEG VOR (NY), NO CLOUDS ABOVE OR BELOW ME. ATC ISSUED A TA: TFC 10 O'CLOCK, 4 MI AT 9.4 MI, SE HDG (MY HDG WAS 060 DEGS). I PICKED UP THE TARGET VISUALLY AT APPROX 1 1/2 TO 2 MI -- AT MY ALT. I QUICKLY BECAME AWARE WE WERE CONVERGING AND DETERMINED SINCE THE INTRUDER WAS MAINTAINING HDG AND ALT, THAT I WOULD DSND IMMEDIATELY. AT 9250 FT THE WHITE TOP/BURGUNDY BOTTOM COLORED MOONEY PASSED DIRECTLY OVERHEAD MY ACFT. IF I HAD NOT DSNDED, WE WOULD HAVE HIT. THE OTHER ACFT DID NOT APPEAR TO SEE ME SINCE I NEVER SAW HIM TAKE ANY EVASIVE ACTION. BECAUSE OF THE TYPE OF CALLOUT ATC MADE ON THIS TARGET, HE WAS NOT IN RADIO CONTACT WITH THE ZNY. I THANKED THE CTLR FOR THE TFC CALL, ADVISING HIM THAT IF HE HAD NOT POINTED IT OUT I WOULD HAVE HIT HIM (THE INTRUDER ACFT).
