Narrative:
We were cleared for ILS DME runway 13 approach at lga. We were behind several other aircraft making this approach. As we commenced the approach the DME was not operating. We continued the approach using the lga VOR and DME and landed. Several aircraft behind us also completed the approach. After landing the ATIS was reporting 'ILS DME runway 13 approach in use, DME OTS.' on analysis, this approach is not legal without its DME, but all aircraft were cleared with DME out. Supplemental information from acn 335351: due to the late change in approachs we neglected to note that the DME was inoperative.

Narrative: WE WERE CLRED FOR ILS DME RWY 13 APCH AT LGA. WE WERE BEHIND SEVERAL OTHER ACFT MAKING THIS APCH. AS WE COMMENCED THE APCH THE DME WAS NOT OPERATING. WE CONTINUED THE APCH USING THE LGA VOR AND DME AND LANDED. SEVERAL ACFT BEHIND US ALSO COMPLETED THE APCH. AFTER LNDG THE ATIS WAS RPTING 'ILS DME RWY 13 APCH IN USE, DME OTS.' ON ANALYSIS, THIS APCH IS NOT LEGAL WITHOUT ITS DME, BUT ALL ACFT WERE CLRED WITH DME OUT. SUPPLEMENTAL INFO FROM ACN 335351: DUE TO THE LATE CHANGE IN APCHS WE NEGLECTED TO NOTE THAT THE DME WAS INOP.
