Narrative:

Center had us level off at 16000 ft because of traffic at 17000 ft. The commuter at 17000 ft called us 'in sight' and we also called the commuter in sight. We were given a clearance to maintain visual separation and climb to our final altitude of FL200. The PF, my chief pilot, started a climb and I thought he was going to level off at 16500 ft to pass below the commuter. Instead of leveling off at 16500 ft, he continued to climb to 16700 ft at which point I leaned on the yoke and stated that 16500 is high enough. We went back down to 16500 ft but before we got there the commuter pilot stated over the radio that he had to turn because of his TCASII. I stated over the radio that we would pass below him but I'm sure he had to follow his TCASII instructions. I have discussed this with my chief pilot and we agree now that 1000 ft vertical separation is close enough even in VMC conditions.

Title: CORP ACFT FLC CLBS IN CLOSE PROX TO ACFT AT CRUISE ABOVE THEM CAUSING A TCASII RA IN THAT ACFT.

Narrative: CTR HAD US LEVEL OFF AT 16000 FT BECAUSE OF TFC AT 17000 FT. THE COMMUTER AT 17000 FT CALLED US 'IN SIGHT' AND WE ALSO CALLED THE COMMUTER IN SIGHT. WE WERE GIVEN A CLRNC TO MAINTAIN VISUAL SEPARATION AND CLB TO OUR FINAL ALT OF FL200. THE PF, MY CHIEF PLT, STARTED A CLB AND I THOUGHT HE WAS GOING TO LEVEL OFF AT 16500 FT TO PASS BELOW THE COMMUTER. INSTEAD OF LEVELING OFF AT 16500 FT, HE CONTINUED TO CLB TO 16700 FT AT WHICH POINT I LEANED ON THE YOKE AND STATED THAT 16500 IS HIGH ENOUGH. WE WENT BACK DOWN TO 16500 FT BUT BEFORE WE GOT THERE THE COMMUTER PLT STATED OVER THE RADIO THAT HE HAD TO TURN BECAUSE OF HIS TCASII. I STATED OVER THE RADIO THAT WE WOULD PASS BELOW HIM BUT I'M SURE HE HAD TO FOLLOW HIS TCASII INSTRUCTIONS. I HAVE DISCUSSED THIS WITH MY CHIEF PLT AND WE AGREE NOW THAT 1000 FT VERT SEPARATION IS CLOSE ENOUGH EVEN IN VMC CONDITIONS.
