Narrative:

Air carrier X departed mia en route to spim through havana's airspace. I had air carrier X on my frequency climbing to FL330. Air carrier X was coordinated with havana climbing to FL330 and a radar handoff was accomplished. Prior to transfer of communication to havana, air carrier X advised me that havana had cleared them to FL370. I advised air carrier X to maintain FL330 as that was the altitude that had been coordinated. This is an increasingly common occurrence--when aircraft contact havana (as required by ICAO rules) prior to crossing their boundary havana controllers are issuing clrncs to these aircraft while they are still in ZMA airspace causing potential conflictions and safety hazard.

Title: CTLR AT FOREIGN ARTCC ASSUMED CTL OF FLT PRIOR TO AIRSPACE BOUNDARY WHEN ACR FLT ESTABLISHED COMS, PER ICAO RULES, BUT BEFORE CTL HAD BEEN TRANSFERRED TO FOREIGN ARTCC.

Narrative: ACR X DEPARTED MIA ENRTE TO SPIM THROUGH HAVANA'S AIRSPACE. I HAD ACR X ON MY FREQ CLBING TO FL330. ACR X WAS COORDINATED WITH HAVANA CLBING TO FL330 AND A RADAR HDOF WAS ACCOMPLISHED. PRIOR TO TRANSFER OF COM TO HAVANA, ACR X ADVISED ME THAT HAVANA HAD CLRED THEM TO FL370. I ADVISED ACR X TO MAINTAIN FL330 AS THAT WAS THE ALT THAT HAD BEEN COORDINATED. THIS IS AN INCREASINGLY COMMON OCCURRENCE--WHEN ACFT CONTACT HAVANA (AS REQUIRED BY ICAO RULES) PRIOR TO XING THEIR BOUNDARY HAVANA CTLRS ARE ISSUING CLRNCS TO THESE ACFT WHILE THEY ARE STILL IN ZMA AIRSPACE CAUSING POTENTIAL CONFLICTIONS AND SAFETY HAZARD.
