Narrative:

We were cleared to maintain heading 330 degrees and 5000 ft. At approximately 2500 ft, departure control said maintain 3000 ft, traffic 12 O'clock. At 2700 ft I noticed on TCASII that our traffic was at 3000 ft and less than 1 mi. I leveled off at 2700 ft and we saw traffic visually going right to left. Then we received a TCASII alert and RA to monitor vertical speed. After the traffic passed, we climbed to 3000 ft. Departure control said that he should have leveled us off at 2000 ft.
