Narrative:

Approximately 50 NM west of cigar we realized we were more than 50 NM from shore in an aircraft that was not overwater certified. ATC cleared direct nepta and we ascertained that we would remain within 162 NM of shore at all times. Based on our position at the time of discovery, we chose to continue our cleared route of flight. Subsequent discussions with dispatch revealed that this aircraft and all airbus A320/319 operated by the company are legal to exceed 50 NM from the nearest shore.
