Narrative:
I was the first officer and the PF. We took off on runway 14 in pit and our initial clearance was to 4000 ft MSL. At 500 ft AGL my PNF made his '500 ft' call. I then called for 'flaps up.' the PNF went to select them and called 'selected,' but as he was selecting them pit departure asked for our first fix. Upon reaching 4000 ft MSL I leveled the airplane and the airspeed increased to approximately 208 KTS. Our flaps 12 degree limitation is 200 KTS. We received a 'flap overspd' cas message. The flaps were then selected up. At this point the after takeoff checks were not finished, but were in the process of being completed. We continued our climb to 12000 ft MSL where maintenance was contacted and advised us to return to pit. The reason it happened was the captain got distracted with ATC's call and never selected flaps up, and since we leveled off at 4000 ft he was not able to get the after takeoff checks done before the airspeed had increased beyond the limitation.

Title: A DO328 CREW, DEPARTING PIT, NEGLECTED TO RETRACT FLAPS IN A TIMELY MANNER, LEADING TO A FLAP OVERSPD CONDITION.

THE REASON IT HAPPENED WAS THE CAPT GOT DISTRACTED WITH ATC'S CALL AND NEVER SELECTED FLAPS UP, AND SINCE WE LEVELED OFF AT 4000 FT HE WAS NOT ABLE TO GET THE AFTER TKOF CHKS DONE BEFORE THE AIRSPD HAD INCREASED BEYOND THE LIMITATION.
