Narrative:
Descending through 13000 ft for 11000 ft at 250 KT, ATC advised VFR traffic 10-11 O'clock position, 4 mi, 9700 ft. Coming out of an overcast, we began looking. TCASII advised 'monitor vertical speed' followed quickly by 'descend now.' the first officer disengaged autoplt, pushed the nose over aggressively. After visually acquiring conflict and TCASII 'clear of conflict,' we leveled at 10000 ft, advised ATC of event, and climbed back to 11000 ft. We continued for uneventful landing in mco. Call to center indicated the conflict was a citation flying VFR with orlando departure from leesburg. He stated he had us in sight. Regardless, we didn't know that and our TCASII didn't like it. Center said it isn't unusual for cpr aircraft to depart the mco area VFR even though they climb through the arrs into mco. WX was a factor that day as we had extensive vectoring due WX and reduced visibility. It may have been technically VMC but not by much. Supplemental information from acn 557775: apparently, the citation was being worked by approach.
Original NASA ASRS Text
Title: POTENTIAL CONFLICT AT 9700 FT BTWN A DSNDING IFR B737 AND A SUPPOSEDLY VMC CITATION CLBING OUT NEAR APCH RTE TO MCO, FL.
Narrative: DSNDING THROUGH 13000 FT FOR 11000 FT AT 250 KT, ATC ADVISED VFR TFC 10-11 O'CLOCK POS, 4 MI, 9700 FT. COMING OUT OF AN OVCST, WE BEGAN LOOKING. TCASII ADVISED 'MONITOR VERT SPD' FOLLOWED QUICKLY BY 'DSND NOW.' THE FO DISENGAGED AUTOPLT, PUSHED THE NOSE OVER AGGRESSIVELY. AFTER VISUALLY ACQUIRING CONFLICT AND TCASII 'CLR OF CONFLICT,' WE LEVELED AT 10000 FT, ADVISED ATC OF EVENT, AND CLBED BACK TO 11000 FT. WE CONTINUED FOR UNEVENTFUL LNDG IN MCO. CALL TO CTR INDICATED THE CONFLICT WAS A CITATION FLYING VFR WITH ORLANDO DEP FROM LEESBURG. HE STATED HE HAD US IN SIGHT. REGARDLESS, WE DIDN'T KNOW THAT AND OUR TCASII DIDN'T LIKE IT. CTR SAID IT ISN'T UNUSUAL FOR CPR ACFT TO DEPART THE MCO AREA VFR EVEN THOUGH THEY CLB THROUGH THE ARRS INTO MCO. WX WAS A FACTOR THAT DAY AS WE HAD EXTENSIVE VECTORING DUE WX AND REDUCED VISIBILITY. IT MAY HAVE BEEN TECHNICALLY VMC BUT NOT BY MUCH. SUPPLEMENTAL INFO FROM ACN 557775: APPARENTLY, THE CITATION WAS BEING WORKED BY APCH.
