Narrative:

This morning, I departed mnv VFR en route to hpn. The WX was good VFR with unlimited visibility. The previous evening I called millville FSS to get an up to date briefing on the current flight restrs around nyc and along my route of flight. The briefer gave what I thought was a thorough briefing. He recommended I file four VFR ADIZ flight plans to cover my flight XA00Z to hpn, XB00Z to 39N, XI00 to GH5, XI30 to mnv. The first two legs were backed up with IFR flight plans. The briefer instructed me to contact ATC once airborne to retrieve my discrete squawk as morristown tower did not start operations until XB45Z. Once airborne, I tried ny TRACON on 127.6 with no reply, then 119.2, also with no reply. I then tried 120.4. The controller informed me to try 127.6 again which I did with no success. I then went back to 120.4 and he informed that I should try the 119.2 frequency. Again, I had no joy. Because from past experience, it is very hard to raise ny TRACON at these early hours when the tower is closed. I then returned to the controller on 120.4 who gave me a 360 degree heading to fly while he got my squawk. By this time, I had reached 2500 ft MSL and was about 8 miles north of morristown airport. The controller then told me to turn heading of 090 degrees -- I believe -- and informed me that I was to be violated for entering the ny ADIZ. As stated earlier, I could not get hold of ny TRACON on the published frequencies, let alone on the ground before take off. On landing at white plains airport, I contacted the number the ny TRACON controller gave me. This controller informed me there was an '800 number' to call to get a discrete squawk before take off if the tower is closed. At no time did millville FSS give me the '800 number.' having flown in the nyc area for fifteen years, I feel reasonably confident working with it's system, but I can only do what I am told by FSS. If I don't receive all the pertinent data, on the almost daily changes to the flight restrs in this area, it is very hard to be incompliance.

THE PREVIOUS EVENING I CALLED MILLVILLE FSS TO GET AN UP TO DATE BRIEFING ON THE CURRENT FLT RESTRS AROUND NYC AND ALONG MY RTE OF FLT. THE BRIEFER GAVE WHAT I THOUGHT WAS A THOROUGH BRIEFING. HE RECOMMENDED I FILE FOUR VFR ADIZ FLT PLANS TO COVER MY FLT XA00Z TO HPN, XB00Z TO 39N, XI00 TO GH5, XI30 TO MNV. THE FIRST TWO LEGS WERE BACKED UP WITH IFR FLT PLANS. I THEN WENT BACK TO 120.4 AND HE INFORMED THAT I SHOULD TRY THE 119.2 FREQUENCY. AGAIN, I HAD NO JOY. BECAUSE FROM PAST EXPERIENCE, IT IS VERY HARD TO RAISE NY TRACON AT THESE EARLY HOURS WHEN THE TWR IS CLOSED. I THEN RETURNED TO THE CTLR ON 120.4 WHO GAVE ME A 360 DEG HDG TO FLY WHILE HE GOT MY SQUAWK. BY THIS TIME, I HAD REACHED 2500 FT MSL AND WAS ABOUT 8 MILES N OF MORRISTOWN ARPT. THE CTLR THEN TOLD ME TO TURN HDG OF 090 DEGS -- I BELIEVE -- AND INFORMED ME THAT I WAS TO BE VIOLATED FOR ENTERING THE NY ADIZ. AS STATED EARLIER, I COULD NOT GET HOLD OF NY TRACON ON THE PUBLISHED FREQUENCIES, LET ALONE ON THE GND BEFORE TAKE OFF. ON LNDG AT WHITE PLAINS ARPT, I CONTACTED THE NUMBER THE NY TRACON CTLR GAVE ME. THIS CTLR INFORMED ME THERE WAS AN '800 NUMBER' TO CALL TO GET A DISCRETE SQUAWK BEFORE TAKE OFF IF THE TWR IS CLOSED. AT NO TIME DID MILLVILLE FSS GIVE ME THE '800 NUMBER.' HAVING FLOWN IN THE NYC AREA FOR FIFTEEN YEARS, I FEEL REASONABLY CONFIDENT WORKING WITH IT'S SYSTEM, BUT I CAN ONLY DO WHAT I AM TOLD BY FSS. IF I DON'T RECEIVE ALL THE PERTINENT DATA, ON THE ALMOST DAILY CHANGES TO THE FLT RESTRS IN THIS AREA, IT IS VERY HARD TO BE INCOMPLIANCE.
