Narrative:
On departure and climb out from iah at 4000 ft, we were given a climb by departure to 15000 ft and delete speed restr and intercept J-86. After passing through 5000 ft, we were told by departure to level at 5000 ft because of traffic at 2 O'clock position, less than a mi at 6000 ft. We reached a maximum altitude of 5600 ft before returning to 5000 ft. We saw a turboprop pass off of our right high and pass behind by 1/2 mi. At that time, we were reclred to 15000 ft. TCASII was inoperative.

Narrative: ON DEP AND CLBOUT FROM IAH AT 4000 FT, WE WERE GIVEN A CLB BY DEP TO 15000 FT AND DELETE SPD RESTR AND INTERCEPT J-86. AFTER PASSING THROUGH 5000 FT, WE WERE TOLD BY DEP TO LEVEL AT 5000 FT BECAUSE OF TFC AT 2 O'CLOCK POS, LESS THAN A MI AT 6000 FT. WE REACHED A MAX ALT OF 5600 FT BEFORE RETURNING TO 5000 FT. WE SAW A TURBOPROP PASS OFF OF OUR R HIGH AND PASS BEHIND BY 1/2 MI. AT THAT TIME, WE WERE RECLRED TO 15000 FT. TCASII WAS INOP.
