Narrative:

After takeoff and positive rate of climb was established; the landing gear handle would not move to the up position. We continued a climb to a safe altitude; and started to analyze the problem. After finding that all circuit breakers were in; and confirming that the landing gear handle would not move; we determined that we did not have enough fuel to reach destination with the landing gear down. We requested a return to ZZZ. After landing in ZZZ; we called dispatch to report the mechanical condition. Due to the late hour we did not reach dispatch and left a message. The owner returned the call about 15 mins later. First officer and I discussed the safety issues involved with ferrying the aircraft home with the landing gear down while waiting for a call back. We determined there were no safety issues associated with this operation. After receiving a call back from the owner; it was decided that we would fuel the aircraft; and return to destination. It was not until we were en route; and almost to our destination that I realized that we should have had a ferry permit for this flight. We landed without incident at destination. Crew recommendations: it is the crew's recommendation that anyone assuming a dispatch function refer the crew to the on call maintenance personnel to make sure that this oversight does not occur in the future.

Title: C560 FLT CREW ACCOMPLISHED FLT WITH KNOWN MALFUNCTION (UNABLE TO RETRACT GEAR) WITHOUT OBTAINING MAINT FERRY PERMIT.

Narrative: AFTER TKOF AND POSITIVE RATE OF CLB WAS ESTABLISHED; THE LNDG GEAR HANDLE WOULD NOT MOVE TO THE UP POS. WE CONTINUED A CLB TO A SAFE ALT; AND STARTED TO ANALYZE THE PROB. AFTER FINDING THAT ALL CIRCUIT BREAKERS WERE IN; AND CONFIRMING THAT THE LNDG GEAR HANDLE WOULD NOT MOVE; WE DETERMINED THAT WE DID NOT HAVE ENOUGH FUEL TO REACH DEST WITH THE LNDG GEAR DOWN. WE REQUESTED A RETURN TO ZZZ. AFTER LNDG IN ZZZ; WE CALLED DISPATCH TO RPT THE MECHANICAL CONDITION. DUE TO THE LATE HR WE DID NOT REACH DISPATCH AND LEFT A MESSAGE. THE OWNER RETURNED THE CALL ABOUT 15 MINS LATER. FO AND I DISCUSSED THE SAFETY ISSUES INVOLVED WITH FERRYING THE ACFT HOME WITH THE LNDG GEAR DOWN WHILE WAITING FOR A CALL BACK. WE DETERMINED THERE WERE NO SAFETY ISSUES ASSOCIATED WITH THIS OP. AFTER RECEIVING A CALL BACK FROM THE OWNER; IT WAS DECIDED THAT WE WOULD FUEL THE ACFT; AND RETURN TO DEST. IT WAS NOT UNTIL WE WERE ENRTE; AND ALMOST TO OUR DEST THAT I REALIZED THAT WE SHOULD HAVE HAD A FERRY PERMIT FOR THIS FLT. WE LANDED WITHOUT INCIDENT AT DEST. CREW RECOMMENDATIONS: IT IS THE CREW'S RECOMMENDATION THAT ANYONE ASSUMING A DISPATCH FUNCTION REFER THE CREW TO THE ON CALL MAINT PERSONNEL TO MAKE SURE THAT THIS OVERSIGHT DOES NOT OCCUR IN THE FUTURE.
