Narrative:
We were on departure from san jose, ca airport using the sjc 4 departure SID. The WX was layered clouds (in and out). We were on a heading of 100 degree climbing through about 10000'. Departure gave us a frequency for oakland center but before he turned us over to oakland he gave us traffic at 1 to 2 O'clock at 10500. He then said turn right to 120 degree. We turned to 120 degree. Our deck angle was high (medium large transport) and airspeed was 250 KTS. We rolled out on 120 degree and I saw the aircraft at about 2 O'clock low. He was an small transport tan in color with a dark stripe down the side. At the time we were climbing through 10700 or 10800'. Departure said we were past the traffic and for us to contact oakland center. I rogered the transmission and reported that we were above the traffic and called oakland.

DEPARTURE GAVE US A FREQ FOR OAKLAND CENTER BUT BEFORE HE TURNED US OVER TO OAKLAND HE GAVE US TFC AT 1 TO 2 O'CLOCK AT 10500. HE THEN SAID TURN RIGHT TO 120 DEG. WE TURNED TO 120 DEG. OUR DECK ANGLE WAS HIGH (MLG) AND AIRSPEED WAS 250 KTS. WE ROLLED OUT ON 120 DEG AND I SAW THE ACFT AT ABOUT 2 O'CLOCK LOW. HE WAS AN SMT TAN IN COLOR WITH A DARK STRIPE DOWN THE SIDE. AT THE TIME WE WERE CLIMBING THROUGH 10700 OR 10800'. DEPARTURE SAID WE WERE PAST THE TFC AND FOR US TO CONTACT OAKLAND CTR. I ROGERED THE XMISSION AND REPORTED THAT WE WERE ABOVE THE TFC AND CALLED OAKLAND.
