Narrative:
Arriving den via the profile descent route over the drako fix. We were cleared to cross drako at 17000'. Descent was delayed to avoid thunderstorm buildups along the route and subsequently we crossed the fix about 3000' high. Actually not over the fix, but with WX avoidance and a vector from ATC, we were at the fix DME arc distance about 3000' high. We were avoiding the buildups totally because of previous reports of moderate turbulence along the arrival route. The radio chatter got busy at the last moments when it was obvious we would be high at the fix, so were unable to inform ATC until the last seconds before handoff to den approach control. Supplemental information from acn 91214: he had me (PNF) tell ATC we would delay starting down due to WX. ATC said ok, but make the restriction. Captain delayed and delayed and I told him we weren't going to make the restriction. He said it would be ok. I asked him if I should tell ATC if we would be high at drako. He said, 'no, it'll be fine.' we crossed drako at 24000' and 280 KTS. Supplemental information from acn 91213: I noticed that the copilot asked the captain if he could make the restriction. He said, 'yes, no problem.' the next thing I knew was that we were at drako at 24000' and 290 KTS.

Title: ACR LGT NON ADHERENCE TO ATC CLRNC. SPEED DEVIATION ALT DEVIATION CROSSING RESTRICTION NOT MET.
Narrative: ARRIVING DEN VIA THE PROFILE DSCNT ROUTE OVER THE DRAKO FIX. WE WERE CLRED TO CROSS DRAKO AT 17000'. DSCNT WAS DELAYED TO AVOID TSTM BUILDUPS ALONG THE ROUTE AND SUBSEQUENTLY WE CROSSED THE FIX ABOUT 3000' HIGH. ACTUALLY NOT OVER THE FIX, BUT WITH WX AVOIDANCE AND A VECTOR FROM ATC, WE WERE AT THE FIX DME ARC DISTANCE ABOUT 3000' HIGH. WE WERE AVOIDING THE BUILDUPS TOTALLY BECAUSE OF PREVIOUS RPTS OF MODERATE TURB ALONG THE ARR ROUTE.
