Narrative:
After takeoff from ewr, the left main gear and nose gear failed to retract. Cycled gear one time. Left main and nose gear still failed to retract. Returned for uneventful landing at ewr. Upon inspection by maintenance, gear pins had not been removed from left main and nose gear. Second officer claims not to have seen pins on his walkaround and the maintenance log was signed off as gear pins removed. Suspect that the gear pin flags were missing, making gear pins easy to overlook. Supplemental information from acn 96823. During my walkaround, no gear pins were seen and positively no gear pin flags were hanging down. I believe someone installed these 2 gear pins at a time that I'm unsure of but with the intent of causing this incident. Only 2 pins were installed. No log book entry was made, and the warning flags were purposely hidden out of view.

Title: LGT TKOF WITH LEFT MAIN AND NOSE GEAR PINS STILL INSTALLED.
Narrative: AFTER TKOF FROM EWR, THE LEFT MAIN GEAR AND NOSE GEAR FAILED TO RETRACT. CYCLED GEAR ONE TIME. LEFT MAIN AND NOSE GEAR STILL FAILED TO RETRACT. RETURNED FOR UNEVENTFUL LNDG AT EWR. UPON INSPECTION BY MAINT, GEAR PINS HAD NOT BEEN REMOVED FROM LEFT MAIN AND NOSE GEAR. S/O CLAIMS NOT TO HAVE SEEN PINS ON HIS WALKAROUND AND THE MAINT LOG WAS SIGNED OFF AS GEAR PINS REMOVED. SUSPECT THAT THE GEAR PIN FLAGS WERE MISSING, MAKING GEAR PINS EASY TO OVERLOOK. SUPPLEMENTAL INFO FROM ACN 96823. DURING MY WALKAROUND, NO GEAR PINS WERE SEEN AND POSITIVELY NO GEAR PIN FLAGS WERE HANGING DOWN. I BELIEVE SOMEONE INSTALLED THESE 2 GEAR PINS AT A TIME THAT I'M UNSURE OF BUT WITH THE INTENT OF CAUSING THIS INCIDENT. ONLY 2 PINS WERE INSTALLED. NO LOG BOOK ENTRY WAS MADE, AND THE WARNING FLAGS WERE PURPOSELY HIDDEN OUT OF VIEW.
