Narrative:
Oak center cleared us for ILS first officer cross the outer marker (munso) at 5000 inbound. As the PNF I informed him that was too high a crossing restriction. We were then told that because mry tower was closed that 5000 was as low as center could approve. Again I told center this was unacceptable. He then cleared us for the approach and terminated radar service. We then were able to descend and fly the approach as published.
