Narrative:
Departed las at 133000# takeoff gross weight. During climb out given crossing restriction. Due to high gross weight, climb performance somewhat less than normal. Able to comply by reducing climb speed, using energy for vertical speed. After frequency change, we began to accelerate back to normal climb schedule. Received a new crossing restriction. 45 NM east of pgs continued climb and advised ATC unable to make crossing restriction by 1500'. ATC replied with new crossing restriction of 55 NM east of pgs. Advised ATC that crossing restriction would be very close. ATC replied to report level at FL330. Tailwind had increased from 47 to 76 component. Airspeed bled back to minimum maneuver in order to increase vertical speed. At 32700' aircraft ran out of vertical speed and ATC asked to report level at FL330 again. Advised ATC that climb performance now 0. ATC gave 40 degree right turn for traffic. During turn ATC demanded increased rate of turn. During turn aircraft began abnormal airframe vibration. Advised ATC that turn would be slow. After established on heading began to accelerate again at 32700'. ATC gave 40 degree left turn to reintercept arwy. Advised ATC that we would like to accelerate before turning back on course, that we had given all aircraft performance attempting to comply with ATC clearance. ATC replied with, 'turn left now 40 degrees and rejoin the arwy.' asked ATC for local phone # contact. Due to time and schedule was unable to contact lax ATC. ATC controller unresponsive to aircraft performance/wind information. Controller should have reclred flight to different altitude. When advised of aircraft performance limits, controller was very insensitive to flight crew's attempt to comply and taking aircraft to absolute limits.

Title: ACR MLG UNABLE TO MAKE ALT CROSSING RESTRICTION.
Narrative: DEPARTED LAS AT 133000# TKOF GROSS WT. DURING CLBOUT GIVEN XING RESTRICTION. DUE TO HIGH GROSS WT, CLB PERFORMANCE SOMEWHAT LESS THAN NORMAL. ABLE TO COMPLY BY REDUCING CLB SPD, USING ENERGY FOR VERT SPD. AFTER FREQ CHANGE, WE BEGAN TO ACCELERATE BACK TO NORMAL CLB SCHEDULE. RECEIVED A NEW XING RESTRICTION. 45 NM E OF PGS CONTINUED CLB AND ADVISED ATC UNABLE TO MAKE XING RESTRICTION BY 1500'. ATC REPLIED WITH NEW XING RESTRICTION OF 55 NM E OF PGS. ADVISED ATC THAT XING RESTRICTION WOULD BE VERY CLOSE. ATC REPLIED TO RPT LEVEL AT FL330. TAILWIND HAD INCREASED FROM 47 TO 76 COMPONENT. AIRSPD BLED BACK TO MINIMUM MANEUVER IN ORDER TO INCREASE VERT SPD. AT 32700' ACFT RAN OUT OF VERT SPD AND ATC ASKED TO RPT LEVEL AT FL330 AGAIN. ADVISED ATC THAT CLB PERFORMANCE NOW 0. ATC GAVE 40 DEG RIGHT TURN FOR TFC. DURING TURN ATC DEMANDED INCREASED RATE OF TURN. DURING TURN ACFT BEGAN ABNORMAL AIRFRAME VIBRATION. ADVISED ATC THAT TURN WOULD BE SLOW. AFTER ESTABLISHED ON HDG BEGAN TO ACCELERATE AGAIN AT 32700'. ATC GAVE 40 DEG LEFT TURN TO REINTERCEPT ARWY. ADVISED ATC THAT WE WOULD LIKE TO ACCELERATE BEFORE TURNING BACK ON COURSE, THAT WE HAD GIVEN ALL ACFT PERFORMANCE ATTEMPTING TO COMPLY WITH ATC CLRNC. ATC REPLIED WITH, 'TURN LEFT NOW 40 DEGS AND REJOIN THE ARWY.' ASKED ATC FOR LCL PHONE # CONTACT. DUE TO TIME AND SCHEDULE WAS UNABLE TO CONTACT LAX ATC. ATC CTLR UNRESPONSIVE TO ACFT PERFORMANCE/WIND INFO. CTLR SHOULD HAVE RECLRED FLT TO DIFFERENT ALT. WHEN ADVISED OF ACFT PERFORMANCE LIMITS, CTLR WAS VERY INSENSITIVE TO FLT CREW'S ATTEMPT TO COMPLY AND TAKING ACFT TO ABSOLUTE LIMITS.
