Narrative:

A northbound small aircraft nearly collided with our wbound light transport. I (captain) recognized the hazard 2 seconds before we passed 50 ft above the small aircraft. I attempted to climb, however, my evasive action had no effect until the aircraft had already passed left to right. We had just completed a chkride at 'gvt' and were returning to 'ads' 30 NM west (8 min). We leveled at 2500 MSL and contacted dfw approach requesting VFR clearance into the TCA. The near miss occurred before radar contact was established. The near miss was caused by the mixing of highspd and lowspd traffic without radar separation. Both flts were operating within the law. I do not believe any change in airspace structure or FARS would help. We must fly turbojets 10000 ft or IFR or both. We should conduct all training/chkrides late at night or early in the morning whenever possible.
