Narrative:

Medium large transport X complying exactly with the dalton departure from teterboro, nj, we were told that we had entered the newark TCA. We were at all times within 4 DME of teb and never above 1300 MSL. I think the dalton VFR departure is a strange clearance to give an aircraft on an IFR departure. I suggest that it be reviewed. Callback conversation with reporter revealed the following information: analyst spoke to procedures specialist at ny TRACON. Procedures specialist stated the dalton departure off teb was developed to expedite departures from teb. The departure has to be requested by the pilot and is not assigned unless requested. If the dalton departure is flown as published, it does not violate the newark TCA.

Narrative: MLG X COMPLYING EXACTLY WITH THE DALTON DEP FROM TETERBORO, NJ, WE WERE TOLD THAT WE HAD ENTERED THE NEWARK TCA. WE WERE AT ALL TIMES WITHIN 4 DME OF TEB AND NEVER ABOVE 1300 MSL. I THINK THE DALTON VFR DEP IS A STRANGE CLRNC TO GIVE AN ACFT ON AN IFR DEP. I SUGGEST THAT IT BE REVIEWED. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: ANALYST SPOKE TO PROCS SPECIALIST AT NY TRACON. PROCS SPECIALIST STATED THE DALTON DEP OFF TEB WAS DEVELOPED TO EXPEDITE DEPS FROM TEB. THE DEP HAS TO BE REQUESTED BY THE PLT AND IS NOT ASSIGNED UNLESS REQUESTED. IF THE DALTON DEP IS FLOWN AS PUBLISHED, IT DOES NOT VIOLATE THE NEWARK TCA.
