Narrative:

While climbing through FL290, first officer (flying) noted traffic displayed on TCASII (30 degree radial, 15 mi, 1200 ft above). First officer informed captain that he (first officer) had better level momentarily at FL300 because traffic (visually sighted) was moving right to left and would be at same altitude if climb continued. Captain called out traffic to ZSU and controller said we were only cleared to FL280. All crew members noted altitude alert set at FL310. Clrncs previously given: sju departure (128.65) direct elmnc passing 11000 ft from a 280 degree heading departing stx. Sju (low) climb to FL310. No clearance to only FL280 had been given. TCASII assist.

Title: FLC OF ACR LGT ACFT DEVIATED FROM ASSIGNED ALT IN RESPONSE TO A TCASII RA RESULTING IN LEARNING THAT THEIR ASSIGNED ALT WAS DIFFERENT FROM THAT THEY HAD RECORDED AND CLBING TO.

Narrative: WHILE CLBING THROUGH FL290, FO (FLYING) NOTED TFC DISPLAYED ON TCASII (30 DEG RADIAL, 15 MI, 1200 FT ABOVE). FO INFORMED CAPT THAT HE (FO) HAD BETTER LEVEL MOMENTARILY AT FL300 BECAUSE TFC (VISUALLY SIGHTED) WAS MOVING R TO L AND WOULD BE AT SAME ALT IF CLB CONTINUED. CAPT CALLED OUT TFC TO ZSU AND CTLR SAID WE WERE ONLY CLRED TO FL280. ALL CREW MEMBERS NOTED ALT ALERT SET AT FL310. CLRNCS PREVIOUSLY GIVEN: SJU DEP (128.65) DIRECT ELMNC PASSING 11000 FT FROM A 280 DEG HDG DEPARTING STX. SJU (LOW) CLB TO FL310. NO CLRNC TO ONLY FL280 HAD BEEN GIVEN. TCASII ASSIST.
