Narrative:
Air carrier X during climb out of phl on 100 degree heading, I received an RA to descend approximately 1500-2000 FPM. I complied with the RA and at about 5000 ft another air carrier Y passed overhead. We informed the controller (departure) of the compliance and resumed our climb to 10000 ft. When questioned, the controller said he had the other traffic also on radar, but thought we had a better rate of climb and therefore did not call traffic to either aircraft.

Title: ACR X NON ADHERENCE TO ATC CLRNC TCASII RA DSND FROM ACFT Y.
Narrative: ACR X DURING CLB OUT OF PHL ON 100 DEG HDG, I RECEIVED AN RA TO DSND APPROX 1500-2000 FPM. I COMPLIED WITH THE RA AND AT ABOUT 5000 FT ANOTHER ACR Y PASSED OVERHEAD. WE INFORMED THE CTLR (DEP) OF THE COMPLIANCE AND RESUMED OUR CLB TO 10000 FT. WHEN QUESTIONED, THE CTLR SAID HE HAD THE OTHER TFC ALSO ON RADAR, BUT THOUGHT WE HAD A BETTER RATE OF CLB AND THEREFORE DID NOT CALL TFC TO EITHER ACFT.
