Narrative:

We were cleared up to FL190 and an oncoming medium large transport was cleared to descend to FL200. We were flying an large transport, our climb being conducted in the flight level change mode. Passing through FL180, our climb rate was approximately 3000 FPM. We got a TCASII TA at about FL184. At about the same time we got a 'climb, climb' RA with a commanded rate of climb of about 4000 FPM. I performed a TCASII altitude deviation which climbed us up through the medium large transport's altitude with loss of separation. The reason for the alert was our rate of climb and the oncoming medium large transport's rate of descent. The TCASII didn't know we were leveling at FL190, and I didn't know what the medium large transport was doing. Our company regulations contradict our operating manual in that our operating manual wants the aircraft to be flown with reference to the AFDS commands which start a level off at 15 percent of the rate of climb which at 3000 FPM is 450 ft before selected altitude. However, the company regulations call for a 1000 FPM within 1000 ft of selected altitude. I suggest a reprogram of the AFDS level off program.

Title: AN ACR LGT CLBED THROUGH ANOTHER ACFT'S ALT IN RESPONSE TO A TCASII COMMAND.

Narrative: WE WERE CLRED UP TO FL190 AND AN ONCOMING MLG WAS CLRED TO DSND TO FL200. WE WERE FLYING AN LGT, OUR CLB BEING CONDUCTED IN THE FLT LEVEL CHANGE MODE. PASSING THROUGH FL180, OUR CLB RATE WAS APPROX 3000 FPM. WE GOT A TCASII TA AT ABOUT FL184. AT ABOUT THE SAME TIME WE GOT A 'CLB, CLB' RA WITH A COMMANDED RATE OF CLB OF ABOUT 4000 FPM. I PERFORMED A TCASII ALTDEV WHICH CLBED US UP THROUGH THE MLG'S ALT WITH LOSS OF SEPARATION. THE REASON FOR THE ALERT WAS OUR RATE OF CLB AND THE ONCOMING MLG'S RATE OF DSCNT. THE TCASII DIDN'T KNOW WE WERE LEVELING AT FL190, AND I DIDN'T KNOW WHAT THE MLG WAS DOING. OUR COMPANY REGS CONTRADICT OUR OPERATING MANUAL IN THAT OUR OPERATING MANUAL WANTS THE ACFT TO BE FLOWN WITH REF TO THE AFDS COMMANDS WHICH START A LEVEL OFF AT 15 PERCENT OF THE RATE OF CLB WHICH AT 3000 FPM IS 450 FT BEFORE SELECTED ALT. HOWEVER, THE COMPANY REGS CALL FOR A 1000 FPM WITHIN 1000 FT OF SELECTED ALT. I SUGGEST A REPROGRAM OF THE AFDS LEVEL OFF PROGRAM.
