Air carrier X advised he was leaving assigned altitude of 5000 ft because of TA told to return to 5000 ft when possible. He stated he was still getting it. Told to level at 6000 ft and said that it must be his equipment because TA followed him up. There was a clearance deviation of 400 ft by the TCASII aircraft. Communication was initiated by the TCASII aircraft during the maneuver. The closest aircraft was 6 mi in front and 7 mi behind.

Title: ACR X TCASII TA NON ADHERENCE TO ATC CLRNC CLB FROM ASSIGNED ALT. GHOST TARGET. ACFT EQUIP PROB TCASII.

Narrative: ACR X ADVISED HE WAS LEAVING ASSIGNED ALT OF 5000 FT BECAUSE OF TA TOLD TO RETURN TO 5000 FT WHEN POSSIBLE. HE STATED HE WAS STILL GETTING IT. TOLD TO LEVEL AT 6000 FT AND SAID THAT IT MUST BE HIS EQUIP BECAUSE TA FOLLOWED HIM UP. THERE WAS A CLRNC DEV OF 400 FT BY THE TCASII ACFT. COM WAS INITIATED BY THE TCASII ACFT DURING THE MANEUVER. THE CLOSEST ACFT WAS 6 MI IN FRONT AND 7 MI BEHIND.
