Narrative:
Approaching vills intersection at FL280, ZNY issued a climb clearance to FL310, our filed flight level. I acknowledged the instruction and flight level. The captain set FL310 in the MCP, announced FL310 and initiated a climb. I pointed at FL310 in the window and repeated FL310. At approximately FL284, the TCASII commanded an RA descent. Almost simultaneously, the controller issued a maintain FL280 call. Another airliner was located at about 1 O'clock, approximately 500 ft above and 1 mi away. The captain immediately disconnected the autoplt, initiated a descent back to FL280 and leveled there. We continued on our flight planned route toward salisbury VOR.

Title: AN ACR FLC IN AN MLG RPTS THAT THEY WERE ASSIGNED A CLB THROUGH AN OCCUPIED ALT AND THAT THEY REACTED PROPERLY TO A TCASII RA. THEY WERE THEN ASSIGNED AN ALT BELOW THE TFC.
Narrative: APCHING VILLS INTXN AT FL280, ZNY ISSUED A CLB CLRNC TO FL310, OUR FILED FLT LEVEL. I ACKNOWLEDGED THE INSTRUCTION AND FLT LEVEL. THE CAPT SET FL310 IN THE MCP, ANNOUNCED FL310 AND INITIATED A CLB. I POINTED AT FL310 IN THE WINDOW AND REPEATED FL310. AT APPROX FL284, THE TCASII COMMANDED AN RA DSCNT. ALMOST SIMULTANEOUSLY, THE CTLR ISSUED A MAINTAIN FL280 CALL. ANOTHER AIRLINER WAS LOCATED AT ABOUT 1 O'CLOCK, APPROX 500 FT ABOVE AND 1 MI AWAY. THE CAPT IMMEDIATELY DISCONNECTED THE AUTOPLT, INITIATED A DSCNT BACK TO FL280 AND LEVELED THERE. WE CONTINUED ON OUR FLT PLANNED RTE TOWARD SALISBURY VOR.
