Narrative:
We were cleared to descend and cross wakem intersection on the wakem 2 arrival, waterville transition from a point well within our performance capability. I confirmed the clearance with the first officer and proceeded with my PNF duties (ATIS and company radio). The initial descent rate was a little shallow and I planned to point this out if it became critical. Unfortunately, I didn't notice our excess altitude again until after I returned to the ATC frequency and pilot intercom. The first officer informed ATC that we would not meet the restr (instead of assertively complying) and ATC asked that we descend as rapidly as practical. With a handoff to approach control and a vector left for the approach, we passed north of waken about 500 ft high. As captain, I should have watched more closely to either assure compliance or get official relief from the restr. No apparent loss of separation occurred and ATC made no further comment. I also need to counsel my first officer about this matter.

Title: AN ACR FLC FLYING EMB145 NEAR WAKEMAN, OH, FAILED TO MEET THE ALT XING RESTR AS ASSIGNED BY ATC.
Narrative: WE WERE CLRED TO DSND AND CROSS WAKEM INTXN ON THE WAKEM 2 ARR, WATERVILLE TRANSITION FROM A POINT WELL WITHIN OUR PERFORMANCE CAPABILITY. I CONFIRMED THE CLRNC WITH THE FO AND PROCEEDED WITH MY PNF DUTIES (ATIS AND COMPANY RADIO). THE INITIAL DSCNT RATE WAS A LITTLE SHALLOW AND I PLANNED TO POINT THIS OUT IF IT BECAME CRITICAL. UNFORTUNATELY, I DIDN'T NOTICE OUR EXCESS ALT AGAIN UNTIL AFTER I RETURNED TO THE ATC FREQ AND PLT INTERCOM. THE FO INFORMED ATC THAT WE WOULD NOT MEET THE RESTR (INSTEAD OF ASSERTIVELY COMPLYING) AND ATC ASKED THAT WE DSND AS RAPIDLY AS PRACTICAL. WITH A HDOF TO APCH CTL AND A VECTOR L FOR THE APCH, WE PASSED N OF WAKEN ABOUT 500 FT HIGH. AS CAPT, I SHOULD HAVE WATCHED MORE CLOSELY TO EITHER ASSURE COMPLIANCE OR GET OFFICIAL RELIEF FROM THE RESTR. NO APPARENT LOSS OF SEPARATION OCCURRED AND ATC MADE NO FURTHER COMMENT. I ALSO NEED TO COUNSEL MY FO ABOUT THIS MATTER.
