Narrative:

We pushed from the gate at XA45 PST. We requested taxi instructions at approximately XA49. As we were given taxi instructions the ground crew was giving me the all clear signal. I reverified with my first officer and he said runway 30L. We had a mindset runway 30L, because when we flew in the night before runway 30R was closed and when we had departure that morning it was still closed. Also when we landed informed there were aircraft departing ahead of us on runway 30L. Also when we were inbound my first officer who was on his first trip since training following a 5 month furlough inadvertently had missed that runway 30R was open for departure only. He later said he had missed this because of trying to copy all of the taxiway closures on the sjc ATIS. To weathering this problem was in the 11 times in the previous 6 weeks that I had ever flown into sjc, runway 30R-12L had been closed. We taxied out and accomplished the before takeoff checklist. As we approached the end of runway 30R we saw no flashing yellow lights warning us of an active runway. We saw an aircraft about 5 miles out for runway 30L. I told my first officer to call the tower as we taxied across runway 30R. We did not know the tower had tried calling us to clear us for departure on runway 30R, we called the tower for the left and hence the incursion had occurred. We were wrong, but upon talking to the tower supervisor this has occurred 7 times since 01/wed /02 making this a serious concern for all! I am not sure what can be done, but we must make sure to try to stop further events at sjc.

I TOLD MY FIRST OFFICER TO CALL THE TOWER AS WE TAXIED ACROSS RWY 30R. WE DID NOT KNOW THE TWR HAD TRIED CALLING US TO CLR US FOR DEP ON RWY 30R, WE CALLED THE TWR FOR THE L AND HENCE THE INCURSION HAD OCCURRED.
