Narrative:

On 04/thu/03, I was checking the WX on wsi at FBO in north philadelphia airport. The WX en route looked VFR. At XA30 we got ATIS and called ground for VFR to pwm at 15500 ft. The ground responded, taxi alpha, hotel, for intersection departure runway 6. I taxied to the runway. I did a run up and prepped the plane for flight. I swapped to tower and called them, 'aircraft X holding short runway 6 at hotel for intersection departure. Do you have a squawk for me?' he replied, 'we don't give squawk codes get it from departure, cleared for take off.' I thought it was a bit weird to get that reply because I frequently fly out of portsmouth, and they have always given me a squawk when I requested it. Nevertheless, I took off totally oblivious to the problem that was about to happen. After I took off I stayed on runway heading. Tower asked me what my on course heading. I replied, '060 degrees.' still the tower never hinted or implied I was heading into trouble. I looked at the GPS and saw he wasn't handing me off to ny center. I increased my climb rate to get us out of the path of traffic in and out of ny, and to give more time to call ny center. After 8 NM from pne, I realized the tower had no intentions of paying attention to me, so I said I was clear of delta and wanted a frequency change. I immediately started to communication with ny, talking to each ATC but not settling in on one. They seemed very busy, so I continued to climb as fast as I could. I still thought I was fine on my spacing to the ADIZ. I think at around 10200 and 19 DME from pne, I had radio and squawk. I continued the climb to 13500 and leveled of there due to headwinds. After a couple of controllers, they said, 'aircraft X got a pen?' they instructed me to call when I landed. Boy was I puzzled! I pulled out my charts and thought of what might have happened. After I landed, I found out I was in or near the ADIZ. I am PIC, the entire flight is my responsibility. The ATC and pilot are a team and should be looking out for each other. I feel the general aviation community doesn't understand the very quickly changing airspace's and flight rules. The airline pilots don't have to struggle to be current. They are spoon feed by their companies and are protected under IFR rules. Thought I understood the ADIZ rules. We need to file a VFR flight plan with flight watch before we get in the plane. If we treat ADIZ like bravo airspace, it simplifies the confusion. Don't enter the ADIZ without getting verbal permission. Don't rely on ATC to help or hint there is a problem. They won't always help.

Title: AIRSPACE INCURSION WHEN A C340A COMMERCIAL PLT ENTERS THE NY ADIZ AT 10500 FT 20 NM NE OF PNE, PA.

I SWAPPED TO TWR AND CALLED THEM, 'ACFT X HOLDING SHORT RWY 6 AT HOTEL FOR INTERSECTION DEP. DO YOU HAVE A SQUAWK FOR ME?' HE REPLIED, 'WE DON'T GIVE SQUAWK CODES GET IT FROM DEP, CLRED FOR TAKE OFF.' I THOUGHT IT WAS A BIT WEIRD TO GET THAT REPLY BECAUSE I FREQUENTLY FLY OUT OF PORTSMOUTH, AND THEY HAVE ALWAYS GIVEN ME A SQUAWK WHEN I REQUESTED IT. NEVERTHELESS, I TOOK OFF TOTALLY OBLIVIOUS TO THE PROB THAT WAS ABOUT TO HAPPEN. AFTER I TOOK OFF I STAYED ON RWY HDG. TWR ASKED ME WHAT MY ON COURSE HDG. I REPLIED, '060 DEGS.' STILL THE TWR NEVER HINTED OR IMPLIED I WAS HDG INTO TROUBLE. I LOOKED AT THE GPS AND SAW HE WASN'T HANDING ME OFF TO NY CTR. I INCREASED MY CLIMB RATE TO GET US OUT OF THE PATH OF TFC IN AND OUT OF NY, AND TO GIVE MORE TIME TO CALL NY CTR. AFTER 8 NM FROM PNE, I REALIZED THE TWR HAD NO INTENTIONS OF PAYING ATTENTION TO ME, SO I SAID I WAS CLR OF DELTA AND WANTED A FREQUENCY CHANGE. I IMMEDIATELY STARTED TO COM WITH NY, TALKING TO EACH ATC BUT NOT SETTLING IN ON ONE. THEY SEEMED VERY BUSY, SO I CONTINUED TO CLIMB AS FAST AS I COULD. I STILL THOUGHT I WAS FINE ON MY SPACING TO THE ADIZ. I THINK AT AROUND 10200 AND 19 DME FROM PNE, I HAD RADIO AND SQUAWK. I CONTINUED THE CLB TO 13500 AND LEVELED OF THERE DUE TO HEADWINDS. I FEEL THE GENERAL AVIATION COMMUNITY DOESN'T UNDERSTAND THE VERY QUICKLY CHANGING AIRSPACE'S AND FLT RULES. THE AIRLINE PLTS DON'T HAVE TO STRUGGLE TO BE CURRENT. THEY ARE SPOON FEED BY THEIR COMPANIES AND ARE PROTECTED UNDER IFR RULES. THOUGHT I UNDERSTOOD THE ADIZ RULES. WE NEED TO FILE A VFR FLT PLAN WITH FLT WATCH BEFORE WE GET IN THE PLANE. IF WE TREAT ADIZ LIKE BRAVO AIRSPACE, IT SIMPLIFIES THE CONFUSION. DON'T ENTER THE ADIZ WITHOUT GETTING VERBAL PERMISSION. DON'T RELY ON ATC TO HELP OR HINT THERE IS A PROBLEM. THEY WON'T ALWAYS HELP.
