Narrative:
The clearance was the teb 5 departure procedure using runway 24. Runway 24 is a known/noted/made aware noise abate runway. Crew departed with an nbaa (national business aircraft assoc) and departure procedure brief. After checking on with approach we were advised to execute the departure procedure for ewr traffic which was in sight, no conflict. Crew was still climbing to 1500 ft MSL when departure vector, 270 degrees, was issued. A right turn to 280 degrees had not been initiated due to climb. Crew is unsure if controller expected right turn sooner. The SID is not clear when turn should be initiated and has conflicting text versus depiction and notes with the depiction. I feel the turn was initiated in a timely fashion per the procedure. To my knowledge, no conflicts with aircraft or airspace occurred. Maximum time travel on a 240 degree versus 280 degree heading is 30 seconds, or the equivalent of 1.25 NM maximum deviation. Noise abate performance conflicts with this procedure and possibly needs to be revised. Lesson -- don't compromise performance!
Original NASA ASRS Text
Title: DA50 CREW DEPARTING TEB ON A TEB 5 DEP, IS GIVEN A VECTOR TURN TO 270 DEGS BEFORE REACHING 1500 FT. CREW OBSERVED EWR TFC AND FELT THERE WAS NO CONFLICT.
Narrative: THE CLRNC WAS THE TEB 5 DEP PROC USING RWY 24. RWY 24 IS A KNOWN/NOTED/MADE AWARE NOISE ABATE RWY. CREW DEPARTED WITH AN NBAA (NATL BUSINESS ACFT ASSOC) AND DEP PROC BRIEF. AFTER CHKING ON WITH APCH WE WERE ADVISED TO EXECUTE THE DEP PROC FOR EWR TFC WHICH WAS IN SIGHT, NO CONFLICT. CREW WAS STILL CLBING TO 1500 FT MSL WHEN DEP VECTOR, 270 DEGS, WAS ISSUED. A R TURN TO 280 DEGS HAD NOT BEEN INITIATED DUE TO CLB. CREW IS UNSURE IF CTLR EXPECTED R TURN SOONER. THE SID IS NOT CLR WHEN TURN SHOULD BE INITIATED AND HAS CONFLICTING TEXT VERSUS DEPICTION AND NOTES WITH THE DEPICTION. I FEEL THE TURN WAS INITIATED IN A TIMELY FASHION PER THE PROC. TO MY KNOWLEDGE, NO CONFLICTS WITH ACFT OR AIRSPACE OCCURRED. MAX TIME TRAVEL ON A 240 DEG VERSUS 280 DEG HDG IS 30 SECONDS, OR THE EQUIVALENT OF 1.25 NM MAX DEV. NOISE ABATE PERFORMANCE CONFLICTS WITH THIS PROC AND POSSIBLY NEEDS TO BE REVISED. LESSON -- DON'T COMPROMISE PERFORMANCE!
