Narrative:

I was flying medium large transport X into pit. We were at FL260 proceeding to indian head. We were under control of ny center, and they cleared us to FL220. We just started to level off at FL220. Then we were told to climb to FL230. Our location was 90-92 NM northeast of indian head. The WX condition was broken clouds. I was able to see another aircraft traveling north or northeast about 1/2-3/4 mi away. We continued to climb and no turn was made. Ny center said they were sorry. Supplemental information from acn 80450: as we began our ascent another aircraft was observed crossing perpendicular to our flight path, approximately 1/2-3/4 mi distance at approximately FL220.

Title: ARTCC RADAR CTLR DESCENDED MLG TO OCCUPIED ALT THEN CLIMBED ACFT IMMEDIATELY, SEPARATION WAS LOST.

Narrative: I WAS FLYING MLG X INTO PIT. WE WERE AT FL260 PROCEEDING TO INDIAN HEAD. WE WERE UNDER CTL OF NY CENTER, AND THEY CLRED US TO FL220. WE JUST STARTED TO LEVEL OFF AT FL220. THEN WE WERE TOLD TO CLB TO FL230. OUR LOCATION WAS 90-92 NM NE OF INDIAN HEAD. THE WX CONDITION WAS BROKEN CLOUDS. I WAS ABLE TO SEE ANOTHER ACFT TRAVELING N OR NE ABOUT 1/2-3/4 MI AWAY. WE CONTINUED TO CLB AND NO TURN WAS MADE. NY CENTER SAID THEY WERE SORRY. SUPPLEMENTAL INFO FROM ACN 80450: AS WE BEGAN OUR ASCENT ANOTHER ACFT WAS OBSERVED XING PERPENDICULAR TO OUR FLT PATH, APPROX 1/2-3/4 MI DISTANCE AT APPROX FL220.
