Narrative:
Upon our takeoff roll we witnessed an small transport cross our runway less than 1000' ahead. We were cleared for takeoff by midway tower and evidently the local controller forgot he had cleared the small transport to land on runway 22R and we were at our rotation speed of 890 KTS on runway 31L when the incursion happened. I feel the controller was at fault by not allowing enough time to ensure the small transport was clear of our runway.

Narrative: UPON OUR TKOF ROLL WE WITNESSED AN SMT CROSS OUR RWY LESS THAN 1000' AHEAD. WE WERE CLRED FOR TKOF BY MIDWAY TWR AND EVIDENTLY THE LCL CTLR FORGOT HE HAD CLRED THE SMT TO LAND ON RWY 22R AND WE WERE AT OUR ROTATION SPEED OF 890 KTS ON RWY 31L WHEN THE INCURSION HAPPENED. I FEEL THE CTLR WAS AT FAULT BY NOT ALLOWING ENOUGH TIME TO ENSURE THE SMT WAS CLEAR OF OUR RWY.
