Narrative:
My routing was hfd direct panze intersection direct 26N at 12500'. I was checking my charts/routing and when I looked for traffic, the large transport was off my right side, slightly behind, and slightly above. My first impression was that the large transport was climbing, but I then watched it descend clear of me. I do not know if ATC had informed the flight of my position or whether or not they were unable to see me. I could have likewise maintained better vigilance for traffic, but the large transport flight path from slightly behind makes it slightly more difficult, while I was at the flight crew's 12 O'clock position. In conclusion, if the flight crew was not told of my position, there is a definite ATC problem. If the crew was told of my near 12 O'clock position and indicated altitude of 12500', they could have, and should have taken action sooner.

Title: CLOSE PROX ACR-LGT GA-SMA SE OF JFK.
Narrative: MY RTING WAS HFD DIRECT PANZE INTXN DIRECT 26N AT 12500'. I WAS CHKING MY CHARTS/RTING AND WHEN I LOOKED FOR TFC, THE LGT WAS OFF MY R SIDE, SLIGHTLY BEHIND, AND SLIGHTLY ABOVE. MY FIRST IMPRESSION WAS THAT THE LGT WAS CLBING, BUT I THEN WATCHED IT DSND CLR OF ME. I DO NOT KNOW IF ATC HAD INFORMED THE FLT OF MY POS OR WHETHER OR NOT THEY WERE UNABLE TO SEE ME. I COULD HAVE LIKEWISE MAINTAINED BETTER VIGILANCE FOR TFC, BUT THE LGT FLT PATH FROM SLIGHTLY BEHIND MAKES IT SLIGHTLY MORE DIFFICULT, WHILE I WAS AT THE FLT CREW'S 12 O'CLOCK POS. IN CONCLUSION, IF THE FLT CREW WAS NOT TOLD OF MY POS, THERE IS A DEFINITE ATC PROB. IF THE CREW WAS TOLD OF MY NEAR 12 O'CLOCK POS AND INDICATED ALT OF 12500', THEY COULD HAVE, AND SHOULD HAVE TAKEN ACTION SOONER.
