Narrative:

Aircraft flying FL290 eastbound, 6 NM, 1 O'clock position. Received TCASII TA, 1400 ft at 3 NM. TCASII RA to 'climb now.' intruder was 1 O'clock, -600 ft. I advised ATC of RA. Some confusion with ATC reference RA. I explained again clearance deviation was 600 ft. Callback conversation with reporter revealed the following: the reporting pilot states that there was another aircraft out there, an medium large transport air carrier. The intruder was not seen visually as the reporter was in IMC. ATC did not call out the intruder aircraft as it was to stop at FL280. The intruder climbed through its altitude, then lied about it when queried by ATC.

Title: AN ACR MLG CLBED IN RESPONSE TO A TCASII COMMAND.

CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING: THE RPTING PLT STATES THAT THERE WAS ANOTHER ACFT OUT THERE, AN MLG ACR. THE INTRUDER WAS NOT SEEN VISUALLY AS THE RPTR WAS IN IMC. ATC DID NOT CALL OUT THE INTRUDER ACFT AS IT WAS TO STOP AT FL280. THE INTRUDER CLBED THROUGH ITS ALT, THEN LIED ABOUT IT WHEN QUERIED BY ATC.
