Narrative:
60 mi south of dqn air carrier X while level at 280 ft received a TCASII RA to climb at 1200 FPM. Flight X climbed to 285 and at that time ATC notified flight X that a pilot deviation has occurred. Flight X had heard prior to TA, ATC request air carrier Y to expedite climb to 270. We believe it was due to the high rate of climb of the other aircraft which caused the TCASII RA, ATC should have called traffic out to both aircraft, and if possible slowed or decreased the lower aircraft rate of climb. This pop-up TCASII advisory could have been avoided. Supplemental information from acn 290308: during cruise we received TCASII climb RA at a rate to exceed 1200 FPM. We complied, climbing to an altitude of 28400 ft. Before clear of conflict. An aircraft was visually confirmed approximately 1000 ft below us. ATC was immediately notified of incident. The other aircraft stated that he was previously instructed to expedite climb to FL270. He was opposite direction, head on traffic to us. ATC informed other aircraft that he had fully complied with all instructions.

Title: ACR X TCASII RA WITH ACR Y EVASIVE ACTION CLB FROM ASSIGNED ALT.
Narrative: 60 MI S OF DQN ACR X WHILE LEVEL AT 280 FT RECEIVED A TCASII RA TO CLB AT 1200 FPM. FLT X CLBED TO 285 AND AT THAT TIME ATC NOTIFIED FLT X THAT A PLTDEV HAS OCCURRED. FLT X HAD HEARD PRIOR TO TA, ATC REQUEST ACR Y TO EXPEDITE CLB TO 270. WE BELIEVE IT WAS DUE TO THE HIGH RATE OF CLB OF THE OTHER ACFT WHICH CAUSED THE TCASII RA, ATC SHOULD HAVE CALLED TFC OUT TO BOTH ACFT, AND IF POSSIBLE SLOWED OR DECREASED THE LOWER ACFT RATE OF CLB. THIS POP-UP TCASII ADVISORY COULD HAVE BEEN AVOIDED. SUPPLEMENTAL INFO FROM ACN 290308: DURING CRUISE WE RECEIVED TCASII CLB RA AT A RATE TO EXCEED 1200 FPM. WE COMPLIED, CLBING TO AN ALT OF 28400 FT. BEFORE CLR OF CONFLICT. AN ACFT WAS VISUALLY CONFIRMED APPROX 1000 FT BELOW US. ATC WAS IMMEDIATELY NOTIFIED OF INCIDENT. THE OTHER ACFT STATED THAT HE WAS PREVIOUSLY INSTRUCTED TO EXPEDITE CLB TO FL270. HE WAS OPPOSITE DIRECTION, HEAD ON TFC TO US. ATC INFORMED OTHER ACFT THAT HE HAD FULLY COMPLIED WITH ALL INSTRUCTIONS.
