Narrative:
I had 2 aircraft, one a B-727 air carrier Y and a falcon jet cpr X. Both just departing from the new york metropolitan area on conflicting rtes of flight. I asked the falcon his rate of climb. He answered 2500 FPM. The falcon was lower than air carrier Y, but I judged I had enough time to get the falcon on top. Unfortunately, the falcon climb only 1200-1500 FPM and was unable to top Y within 5 mi. I should have been aware sooner the falcon's climb rate was not going to be enough but at the moment it was difficult to change plans once I decided to top Y.

Title: CPR X CLB THROUGH OCCUPIED ALT HAD LTSS FROM ACR Y. SYS ERROR.
Narrative: I HAD 2 ACFT, ONE A B-727 ACR Y AND A FALCON JET CPR X. BOTH JUST DEPARTING FROM THE NEW YORK METRO AREA ON CONFLICTING RTES OF FLT. I ASKED THE FALCON HIS RATE OF CLB.
