Narrative:
While approaching bhm for landing on runway 23, a near miss occurred between us in a lear 31 and a single engine mooney. We were cleared to land on runway 23 and the mooney was cleared for touch and go on runway 36. I believe the tower did not see the conflict soon enough to take action necessary. The mooney was trying to avoid the conflict, after his lift off with an evasive corrections prior to the crossing runway, however, momentum carried him into our landing flight path at the runway crossing point which put him right in our flight path. We (the lear aircraft) took evasive action by banking right and adding power for go around. The tower did tell the mooney to abort takeoff, with no response from him and also told us to go around. We did not realize the conflict until we saw the mooney after lift off. We did see the mooney before we were told to go around and had already started the go around when tower told us to do so. I have no way of knowing if the mooney heard the abort from the tower.

Title: NMAC BTWN A LEAR JET AND A MOONEY OVER INTERSECTING RWYS AT A CTLED ARPT.
Narrative: WHILE APCHING BHM FOR LNDG ON RWY 23, A NEAR MISS OCCURRED BTWN US IN A LEAR 31 AND A SINGLE ENG MOONEY. WE WERE CLRED TO LAND ON RWY 23 AND THE MOONEY WAS CLRED FOR TOUCH AND GO ON RWY 36. I BELIEVE THE TWR DID NOT SEE THE CONFLICT SOON ENOUGH TO TAKE ACTION NECESSARY. THE MOONEY WAS TRYING TO AVOID THE CONFLICT, AFTER HIS LIFT OFF WITH AN EVASIVE CORRECTIONS PRIOR TO THE XING RWY, HOWEVER, MOMENTUM CARRIED HIM INTO OUR LNDG FLT PATH AT THE RWY XING POINT WHICH PUT HIM RIGHT IN OUR FLT PATH. WE (THE LEAR ACFT) TOOK EVASIVE ACTION BY BANKING R AND ADDING PWR FOR GAR. THE TWR DID TELL THE MOONEY TO ABORT TKOF, WITH NO RESPONSE FROM HIM AND ALSO TOLD US TO GO AROUND. WE DID NOT REALIZE THE CONFLICT UNTIL WE SAW THE MOONEY AFTER LIFT OFF. WE DID SEE THE MOONEY BEFORE WE WERE TOLD TO GAR AND HAD ALREADY STARTED THE GAR WHEN TWR TOLD US TO DO SO. I HAVE NO WAY OF KNOWING IF THE MOONEY HEARD THE ABORT FROM THE TWR.
