Narrative:

After departure from cle, during climb out and after handoff to ZOB, our flight was cleared to FL230. Passing 15700 ft, the controller hurriedly reclred our flight to maintain 16000 ft. At that time the aircraft was climbing in excess of 4000 FPM. The aircraft was leveled off as fast as safely possible and then returned to 16000 ft. During leveloff, the aircraft reached approximately 16500 ft. Due to frequency congestion the controller was not notified immediately. The flight was subsequently cleared to FL180 and higher. At the time the center controller appeared to be very busy and the frequency was very congested. TCASII showed numerous aircraft in our vicinity. This situation could have been prevented if the controller had not been so busy. Under the circumstances (climb rate of +4000 FPM) the aircraft could not be safely leveled off with just 300 ft of notice.

Narrative: AFTER DEP FROM CLE, DURING CLBOUT AND AFTER HDOF TO ZOB, OUR FLT WAS CLRED TO FL230. PASSING 15700 FT, THE CTLR HURRIEDLY RECLRED OUR FLT TO MAINTAIN 16000 FT. AT THAT TIME THE ACFT WAS CLBING IN EXCESS OF 4000 FPM. THE ACFT WAS LEVELED OFF AS FAST AS SAFELY POSSIBLE AND THEN RETURNED TO 16000 FT. DURING LEVELOFF, THE ACFT REACHED APPROX 16500 FT. DUE TO FREQ CONGESTION THE CTLR WAS NOT NOTIFIED IMMEDIATELY. THE FLT WAS SUBSEQUENTLY CLRED TO FL180 AND HIGHER. AT THE TIME THE CTR CTLR APPEARED TO BE VERY BUSY AND THE FREQ WAS VERY CONGESTED. TCASII SHOWED NUMEROUS ACFT IN OUR VICINITY. THIS SIT COULD HAVE BEEN PREVENTED IF THE CTLR HAD NOT BEEN SO BUSY. UNDER THE CIRCUMSTANCES (CLB RATE OF +4000 FPM) THE ACFT COULD NOT BE SAFELY LEVELED OFF WITH JUST 300 FT OF NOTICE.
