Narrative:

Departure control called traffic 2 times, altitude unknown at 1 O'clock. Sighted aircraft on collision course at altitude 5500'. We were climbing 2000 FPM. At 5300' took evasive action, right 45 degree bank turn to miss red and white small aircraft. No time to level off or descended or climb. Small aircraft was flying VFR, no apparent flight plan, no radio contact. Small aircraft made no attempt to evade. Small aircraft flew off radar scope west/O radio contact. Light aircraft should all have transponders and should be made to file flight plans at all times, and must be in radio contact with ATC at all times. My instincts from military flying of intercepts in air defense command prevented a certain midair collision. No passenger were hurt in this incident, nor were any crew members. We were lucky!

AT 5300' TOOK EVASIVE ACTION, RIGHT 45 DEG BANK TURN TO MISS RED AND WHITE SMA. NO TIME TO LEVEL OFF OR DESCENDED OR CLB. SMA WAS FLYING VFR, NO APPARENT FLT PLAN, NO RADIO CONTACT. SMA MADE NO ATTEMPT TO EVADE. SMA FLEW OFF RADAR SCOPE W/O RADIO CONTACT. LIGHT ACFT SHOULD ALL HAVE TRANSPONDERS AND SHOULD BE MADE TO FILE FLT PLANS AT ALL TIMES, AND MUST BE IN RADIO CONTACT WITH ATC AT ALL TIMES. MY INSTINCTS FROM MIL FLYING OF INTERCEPTS IN AIR DEFENSE COMMAND PREVENTED A CERTAIN MIDAIR COLLISION. NO PAX WERE HURT IN THIS INCIDENT, NOR WERE ANY CREW MEMBERS. WE WERE LUCKY!
