Narrative:
Since the new PATSS1 RNAV SID has started; there have been numerous misapplications of the ZBW/A90 LOA. The agreement made that there would be no changes; is not being followed by A90; nor was it briefed that way. As this is continuing; and safety concerns are identified; the FAA has refused to do anything to alleviate the risks associated. A bulletin was put out in ZBW area C discussing that the controllers need to use extreme caution; and that although formally agreed; we should anticipate A90 using the RNAV procedures. The first departure out of bos today was an A319/Q. This aircraft is capable of flying the RNAV patss SID. Instead; the aircraft departed on the logan departure. No coordination was provided from A90 and when I asked the aircraft what they were flying; they informed me A90 assigned a 260 heading as they departed on the logan SID. How are the controllers at ZBW supposed to know which SID is being used? How are ZBW controllers supposed to determine which heading; or not; is assigned? Why are aircraft coming out on other than the PATSS1 when they are capable of flying it? There are numerous risks that have been identified already. Recommendation; determination must be made as to which departure is being used. Everyone needs to have equipment available to determine which runway is in use.
