Narrative:

I departed bos. Flight was 1 hour late, during after takeoff check I noticed the gear had not gone up. My first officer and I went through the checklist to see if we could get the gear up. We were being vectored at this time. We could not get the gear to come up. By this time we're on course. I felt this was not an emergency situation so I diverted to mht airport where my company said they would have another plane waiting. We landed at mgt and put the passengers on the new plane and went on to pwm. I feel I used poor judgement in diverting instead of landing back at bos. Part of what may have contributed to this decision was being tired, being late, boston airport being busy and my wanting to get passengers to their destination. I thought I was making a good decision at the time but in retrospect I can see I used poor judgement and may have violated FARS.

Title: AFTER TKOF AT BOS GEAR WOULD NOT RETRACT ON SMT COMMUTER. CONTINUED TO MHT WHERE MAINT COULD BE PERFORMED AND A SWAP ACFT WOULD BE WAITING FOR PAX GOING TO PWM.

Narrative: I DEPARTED BOS. FLT WAS 1 HR LATE, DURING AFTER TKOF CHK I NOTICED THE GEAR HAD NOT GONE UP. MY FO AND I WENT THROUGH THE CHKLIST TO SEE IF WE COULD GET THE GEAR UP. WE WERE BEING VECTORED AT THIS TIME. WE COULD NOT GET THE GEAR TO COME UP. BY THIS TIME WE'RE ON COURSE. I FELT THIS WAS NOT AN EMER SITUATION SO I DIVERTED TO MHT ARPT WHERE MY COMPANY SAID THEY WOULD HAVE ANOTHER PLANE WAITING. WE LANDED AT MGT AND PUT THE PAXS ON THE NEW PLANE AND WENT ON TO PWM. I FEEL I USED POOR JUDGEMENT IN DIVERTING INSTEAD OF LNDG BACK AT BOS. PART OF WHAT MAY HAVE CONTRIBUTED TO THIS DECISION WAS BEING TIRED, BEING LATE, BOSTON ARPT BEING BUSY AND MY WANTING TO GET PAXS TO THEIR DEST. I THOUGHT I WAS MAKING A GOOD DECISION AT THE TIME BUT IN RETROSPECT I CAN SEE I USED POOR JUDGEMENT AND MAY HAVE VIOLATED FARS.
