Narrative:
While in level cruise at FL290 in IMC approximately 130 DME out on the 290 degree radial of alb, TCASII issued a TA for a wbound aircraft level at FL280 at 11-12 O'clock. At approximately 124 DME TCASII issued an RA for same aircraft target, requested a climb of approximately 1500 FPM. The RA was followed and aircraft was maneuvered up to 29600 ft when a 'clear of conflict' advisory was issued. ATC was advised and we were instructed to descend to FL290 and they confirmed that the wbound aircraft had remained at FL280. It was our belief that TCASII was faulty, therefore, it was turned off and deferred as inoperative by maintenance.

Title: FO OF ACR MLG ACFT DEVIATED FROM ASSIGNED ALT IN RESPONSE TO TCASII RA.
Narrative: WHILE IN LEVEL CRUISE AT FL290 IN IMC APPROX 130 DME OUT ON THE 290 DEG RADIAL OF ALB, TCASII ISSUED A TA FOR A WBOUND ACFT LEVEL AT FL280 AT 11-12 O'CLOCK. AT APPROX 124 DME TCASII ISSUED AN RA FOR SAME ACFT TARGET, REQUESTED A CLB OF APPROX 1500 FPM. THE RA WAS FOLLOWED AND ACFT WAS MANEUVERED UP TO 29600 FT WHEN A 'CLR OF CONFLICT' ADVISORY WAS ISSUED. ATC WAS ADVISED AND WE WERE INSTRUCTED TO DSND TO FL290 AND THEY CONFIRMED THAT THE WBOUND ACFT HAD REMAINED AT FL280. IT WAS OUR BELIEF THAT TCASII WAS FAULTY, THEREFORE, IT WAS TURNED OFF AND DEFERRED AS INOP BY MAINT.
